Report

For foreign-invested enterprises, you need to submit the annual report on the operation of the investment project and, a report on the supervision of the investment project. In case you have foreign loan activities, you need to make a report on foreign loans and some other reports related to business operations, such as: a report on labor, a report on tax, a statistical report, a report on overseas investment (if any), etc.

Labor compliance

We help you maintain the labor compliance of enterprises such as helping you establish Labor Contracts in accordance with regulations and optimize the benefits of enterprises, recruiting Vietnamese workers, monitoring management of foreign employees, reporting on labor increases and decreases, warning the mandatory procedures you must conduct with labor management agencies in Vietnam.

Tax compliance

We take actions to help you comply with tax and accounting regulations in Vietnam such as: monthly or quarterly VAT reports, quarterly corporate income tax reports, corporate income tax finalization, personal income tax declaration, and finalization, perform operations to avoid double taxation for you and foreigners (if any), set up accounting books, issuing e-invoices for customers of enterprises. In Vietnam, punctually and fully fulfilling tax obligations is compulsory.

Corporate secretary

The Board of Lawyers and Counsels reviews the service content prepared by the assigned personnel before it is sent to clients for their review.

Clients’ approval

Clients review and approve the service content prepared by CDLAF.  When requested, meetings are held to explain the prepared content.

Completion

Personnel responsible for service completion directly implement it at the competent authority (if required). They also monitor the progress, report the results, and hand them over to clients.

After-service support

Guide clients to perform necessary tasks related to the delivered results and provide updates on changes in legal regulations.

What types of investment reports do enterprises have to submit?

Report on investment activities in Vietnam

During the year, enterprises must make Quarterly Reports and Annual Reports. Quarterly reports must be submitted before the 10th day of the first month of the next quarter (the report must be made after the quarter). Annual reports shall be made before March 31 of the following year after the reporting year.

Report on investment monitoring and evaluation

This type of report is for the purpose of monitoring and evaluating the effectiveness of investment projects, so corresponding to each investment project, the enterprise must prepare a 6-month investment monitoring and evaluation report and Annual report. The 6-month report must be completed and submitted before February 10 of the following year after the reporting year.

Can enterprises negotiate salaries in foreign currency?

Enterprises are allowed to negotiate the salary recorded in the Contract and the salaries paid to employees in foreign currency if the employee is a foreigner working at the enterprise.

Do foreign workers have to participate in Compulsory Social Insurance?

Employees who are foreign citizens working in Vietnam are subject to compulsory social insurance when they have a work permit or practising certificate or practising license issued by Vietnamese competent agency and enter into an indefinite-term labor contract or a definite-term labor contract with the period of 1 year or more with an employer in Vietnam.

Foreign workers will not be subject to compulsory social insurance in one of the following cases: (i) Moving in the internal enterprise prescribed by regulations or (ii) The worker has reached retirement age in accordance with the provisions of the Labor Code.

Which foreigner is required to have a Work Permit?

Based on the subjects listed below, the enterprise determines whether the foreigner expecting to work at the enterprise must have a Work Permit. Specifically, foreigners work in Vietnam in the following forms:

  • Performing the labor contracts;
  •  Moving in the internal enterprise;
  • Performing contracts or agreements on business, commerce, finance, banking, insurance, science and technology, culture, sports, education, professional education, and health;
  • Services provider under contracts;
  • Offering services;
  • Working for foreign non-governmental organizations or international organizations in Vietnam that have been granted with operating licenses in accordance with the law of Vietnam;
  • Working as manager, chief executive officers, experts, technicians;
  • Participating in the performance of bid packages and projects in Vietnam.
How many types of Labor Contracts are in Vietnam?

Currently, there are 02 types of labor contract in Vietnam, including:

  • An indefinite-term labor contract is a contract in which the two parties do not determine the term or termination date of the contract;
  • A fixed-term labor contract is a contract in which the two parties determine the term and termination date of the contract within a period of no more than 36 months from the effective date of the contract.
